DIGITAL MILLENNIUM COPYRIGHT ACT POLICY

TOTAL REAL ESTATE GROUP

Total Real Estate Group, LLC (“Total Real Estate Group”) understands the importance of protecting intellectual property rights.  This applies not only to its operations, but with respect to all of the websites of Total Real Estate Group, including www.total-property.com and any other websites operated by Total Real Estate Group (collectively, the “Sites”).   Pursuant to the Digital Millennium Copyright Act of 1998 (17 U.S.C. 512), the full text of which is available at www.copyright.gov/title17/92chap5.html#512, Total Real Estate Group has implemented procedures for receiving notices of claimed copyright infringement (“Notices”) and has designated an agent to receive those Notices.  Total Real Estate Group also has implemented procedures for submitting counter-notices should you receive a notice of copyright infringement you believe to be erroneous (“Counter-Notices”).  Total Real Estate Group reserves the right, in its sole discretion, to block or remove any objectionable content or material.  Regardless of whether Total Real Estate Group removes or blocks content or material, Total Real Estate Group will make a good-faith effort to notify you if a copyright infringement complaint is made against you.

COMPLAINT PROCESS:

If you believe that material on or linked to by the Sites (all capitalized terms not defined in this Policy have the same meanings as in Total Real Estate Group’s Terms of Service, which is incorporated herein by reference) or otherwise being provided in connection with the services infringes one or more of your copyrights, please immediately notify Total Real Estate Group copyright agent by means of a mailed or emailed notice (“Infringement Notice”) providing the information described below.  The copyright agent may be reached at admin@total-property.com.

If Total Real Estate Group takes action in response to an Infringement Notice, it will make a good faith attempt to contact the party that made such content available by means of the most recent email address, if any, provided by such party to Total Real Estate Group, and will provide a copy of the Infringement Notice to such party. Please be advised that you may be held liable for damages based on certain material misrepresentations contained in an Infringement Notice. Thus, if you are not sure content located on or linked-to by the Website infringes your copyright, you should consider first contacting an attorney.

INFRINGEMENT NOTICES

All infringement notices should include the following:

  1. A signature, electronic or physical, of the copyright owner or a person authorized to act on their behalf;
  2. An identification of the copyright claimed to have been infringed;
  3. A description of the nature and location of the material that you claim to infringe your copyright, in sufficient detail to permit Total Real Estate Group to find and positively identify that material;
  4. Your name, address, telephone number and email address; and,
  5. A statement by you: (i) that you believe in good faith that the use of the material that you claim to infringe your copyright is not authorized by law, or by the copyright owner or such owner’s agent; and, (ii) under penalty of perjury, that all of the information contained in your Infringement Notice is accurate, and that you are either the copyright owner or a person authorized to act on their behalf.
